Buyer's Agent Please read the following before submitting offers:

 

 

 

Requirements for Short-Sale Purchase Agreement

 

The following line items are mandatory: 

 

C.A.R. Form RPA (Residential Purchase Agreement)

 

1.     Must use current WINFORMS C.A.R. Form RPA (Residential Purchase Agreement) or NODPA (Notice of Default Purchase Agreement).

 

 2.     Sale not subject to Buyer’s loan interest rate and/or terms.

 

 3.     Do not check Clause 2.I.(ii)

 

 4.     Do not include C.A.R. Form WPA (Wood Destroying Pest Inspection).

 

 5.     The Natural Hazard Zone Disclosure to be Disclosure Source.

 

 6.     Escrow: Each to Pay Their Own.  Stewart Tile & Escrow: “Irene Shepard”.

 

 7.     Title: Ca. Homeowners Policy.  Lawyers Title:  “Nicole McGrath”.

 

 8.     Buyer to pay for Home Warranty.  Fidelity National Home Warranty.

 

 9.     If Applicable, Buyer to pay for HOA transfer fee and document preparation fee.

 

 10.   Include C.A.R. Form CC (Cancellation of Contract, Release of Deposit and Escrow Instructions).  Section 1.  Check items 1. both Buyer and Seller / 1.F. Mutual Agreement.  Section 2. Check item 2.A. Sign both sections.  (( This is just to sit in the file and be available to get the buyer's deposit back quickly if needed))  If you are uncomfortable with this then don't send.

 

 11.   Include C.A.R. Form SSA (Short-Sale Addendum), Clause A. to be 45 Days.  Clause B.2.(ii) leave un-checked.

Note: If complex is not FHA or VA Approved, Buyer is responsible for securing certification prior to their offer being accepted and agrees to pay all fees associated for the certification.  Buyer accepts all financial responsibility and will not be reimbursed any monies in the event lien holders do not approve Short-Sale.
